KitchenAid® and Sutter Home® Kitchen Appliances Giveaway Sweepstakes

OFFICIAL RULES

1. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID IN FLORIDA, NEW YORK, AND ALL U.S. TERRITORIES AND POSSESSIONS AND WHERE PROHIBITED BY LAW, INCLUDING CALIFORNIA AND PUERTO RICO. The KitchenAid & Sutter Home Kitchen Appliances Giveaway Sweepstakes (“Sweepstakes) begins March 1, 2010 at 12:00 Noon Pacific Standard Time and ends May 31, 2010 at Noon Pacific Daylight Time.

2. ELIGIBILITY: Sweepstakes is open to legal residents of the United States (excluding residents of Florida, New York, California, Puerto Rico and all U.S. territories and possessions) who are 21 years of age or older at the time of entry and who, for those entering via Internet, had Internet access prior to March 1, 2010. Employees and their immediate families (spouses and parents, siblings and children and their spouses) of Sponsors, their affiliates or subsidiaries, their advertising agencies, any other company involved with the design, production, execution or distribution of this promotion, licensed alcohol beverage retailers and wholesalers or any other alcohol beverage licensee and their immediate families are not eligible to enter. Grand Prize winner is required to be twenty-one (21) years of age or older as of entry date. Void where prohibited. All federal, state and local rules and regulations apply.

3. ENTRIES. Internet entry: Go to www.sutterhome.com and look for the KitchenAid Sweepstakes entry icon. Tennessee residents can only enter via U.S. Mail. Follow the instructions to enter the Sweepstakes. One entry per person, email address, or household. Should multiple users of the same e-mail account enter the Sweepstakes and a dispute thereafter arises regarding the identity of the entrant, the authorized subscriber of the e-mail account at the time of entry will be considered the entrant. Authorized account subscriber is defined as the natural person who is assigned an e-mail address by an internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Any use of robotic, automatic, programmed or like means to enter the Sweepstakes will void all entries affected by such methods. Sponsors and their agencies are not responsible for unauthorized human intervention, phone, technical, network, electronic, computer, hardware or software failures, malfunctions or disconnects of any kind, or misdirected, illegible, incomplete, stolen, garbled, fragmented or delayed internet/e-mail computer transmissions or network/ISP/website internet accessibility; or for inaccurate, incorrect or incomplete capture of entry information.

For entry by US Mail: Enter by printing your name, complete address, telephone number, e-mail address (optional), and date of birth on a 5”x 3” index card and mail to: CMS Center, Attn: KitchenAid Sweeps Program, ID: SHDREAM10, P.O. Box 426008, Del Rio, TX 78842-6008. One entry per person, per address, per envelope. Sponsors and their agencies will not be responsible for incomplete, illegible, lost, late, postage-due, misdirected or mutilated entries. All entries must be postmarked between March 1, 2010 and May 31, 2010.

4. PRIZE(S). One (1) Grand Prize winner will be selected, from among all eligible entries received, in a random drawing on or about June 15, 2010. The drawing will be conducted by an independent judging organization. Odds of winning the Grand Prize are determined by the number of eligible entries received. The Grand Prize is: Winner’s choice of KitchenAid appliances totaling $5,000.00 (ARV). KitchenAid will ship the appliances to the winner within the continental U.S. Winner is responsible for any tax liability, appliance setup and installation charges. Approximate Retail Value (ARV) $5,000.00. Any other expenses not mentioned are the sole responsibility of the winner. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute a prize in whole or in part with another prize of comparable or greater value if the intended prize is not available for any reason as determined by the Sponsor in its sole discretion.

5. GENERAL: Grand Prize winner will be notified by phone, e-mail and/or certified mail. Grand Prize winner will be required to sign an Affidavit of Eligibility and Liability/Publicity Release and return it within 7 days of attempted delivery or an alternate winner may be selected. Winner hereby consents to the use of her/his name, voice and/or likeness by the Sponsors for advertising purposes without additional compensation unless otherwise prohibited by law. Sponsors are not responsible for late, lost or misdirected mail or illegible information. All entries become the property of the Sponsors and will not be returned. Winner is responsible for all federal, state and local taxes. By entering, participants agree to be bound by the Official Rules. The Sponsors retain the discretion to make all decisions regarding the interpretation and application of these Official Rules, including any ambiguities. All decisions of the Sponsors and the independent judging organization are final and discretionary. By participating in the Sweepstakes, participants and winner release Sponsors and their parents, partners, affiliates, subsidiaries, officers, agents, employees, advertising agencies and all others associated with the development and execution of the Sweepstakes from and against any and all liability with respect to or in any way arising from the Sweepstakes and/or use of the prize, including, without limitation, liability for personal injury, damage or loss.
